Internet Connection All pages are accessible with a dial-up connection. Streaming media is best experienced with a broadband connection. TERMS Note: The following terms and conditions shall govern any purchase made by you of any product owned or controlled by Casablanca Trax Inc., its subsidiary corporations, licensees and affiliates ("Casablanca"). By placing an order with Casablanca Trax Inc., you are deemed to have read, understood and agreed to the following: Product Pricing and Availability All prices indicated are in U.S. funds. Prices and availability are subject to change without notice. If an item which you have requested is sold out and placed on backorder status or is currently out of production we will notify you by telephone, fax or email and your order will not be processed until you advise us how you wish to proceed. Please note that in the case of multiple items, Casablanca Trax Inc. may ship items as they become available. As a result, your order may be shipped to you in a number of pieces. Payment Information All on-line payments are processed through PSIGate and not by Casablanca Trax Inc. and are subject to their terms and conditions. Please review all information provided by PSIGate during the online payment process. If you order online, we will accept VISA, MASTERCARD and PayPal. If you fax or telephone your order, we will accept VISA or MASTERCARD, certified cheque or money order (non-Canadian customers please send International money orders only). We do not accept PayPal other than on-line. Please note that goods will not be shipped until payment is received. Please fax or email your order and forward your money order or certified cheque to the address set out above, to the attention of "Customer Service", or provide us with your credit card information by telephone. All Canadian orders are subject to applicable taxes, based upon your shipping address. Please refer to "Shipping Information". Cancellations You may cancel your order at any time prior to shipping. Please refer to our returns policy in the event that your product has been shipped. Returns We will be happy to offer a refund on product returned within 15 days following receipt of your order. The original receipt must accompany all returns and product must be returned in its original unopened condition. Simply mail it back to us pre-paid freight, together with the original receipt, your name, address and reasons for returning the item, to the address set out above, to the attention of "Customer Service". If payment was made by VISA or MASTERCARD, the refund will be applied against the same card that was originally billed. If payment was made by PayPal, a refund will be returned to your PayPal account. If payment was made by money order, a refund check will be issued to you within 15 business days of receipt of the returned product and sent by regular postal service. Please note that Casablanca Trax Inc. will not be responsible for return shipping and handling charges unless an error was made on the part of Casablanca Trax Inc. Casablanca Trax Inc. is also not responsible for lost returns. It is highly recommended that you return your merchandise by insured Parcel Post or courier. Where orders are marked "Return To Sender", Casablanca Trax Inc. will not be responsible for any additional fees levied by the post office which will be deducted from your returned order total. DO NOT return anything freight collect as it will be refused. Casablanca Trax Inc. reserves the right to reject a return if any of the above conditions are not met or in the case of excessive returns. Lost or Damaged Products If you receive any item that is damaged, you can contact Casablanca Trax Inc. by telephone, fax or email. Please include all of the details and mail the damaged product back to us at the address set out above, to the attention of "Customer Service". A replacement will be sent once we have received the damaged product and we will credit your account for the full amount of the return shipping charges. Please forward a copy of your shipping receipt as proof of return cost. If any item is lost during shipment to you, we will replace it once the maximum shipment delivery time has expired. Shipping Information Casablanca Trax Inc. will ship orders within North America and to most international locations. Your final shipping charges will be determined by the number of items in your order and your shipping address. Please note that all shipping fees and delivery schedules are subject to change without notice. For orders within within North America shipping charges are as indicated during checkout. For orders outside North America, shipping charges will be calculated according to destination. Order Total & Shipping Charge All orders will be shipped to you by regular mail service. If you wish to have your order shipped to you on a rush basis, please let us know and we will arrange to have it couriered and bill you for the additional costs. If your order includes items which are currently available as well as items that are temporarily out of stock, we will notify you by telephone, fax or email to verify whether you wish to have your order shipped as available or shipped after all items become available. If you choose to have your order shipped as items become available, each shipment will be subject to shipping charges, based on the total number of items per shipment and shipping location. Please note that if any delivery times are indicated, these are approximate estimates and may be delayed due to customs inspection. For shipments outside of Canada, you will be responsible for any customs import duties or taxes that may be levied (including customs clearance and brokerage charges). We recommend that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your order. Each order will contain a customs declaration that sets out the package’s contents and value. Casablanca Trax Inc. cannot be held responsible for international taxes or levies charged to your order. Jurisdiction Any dispute regarding the above-noted terms and conditions shall be governed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. Each of the parties hereto irrevocably attorns to the jurisdiction of the courts of the Province of Ontario. General Contract Terms Article and section headings are for convenience only and shall not be used to interpret or construe this Agreement. This Agreement may not be cancelled, altered, modified, amended or waived, in part or in full, in any way except by an instrument in writing signed by each of the parties hereto. No waiver of any provision of this Agreement or any default hereunder shall affect either party's right thereafter to enforce such provision or to exercise any right or remedy in the event of any default whether or not similar. This Agreement sets out the entire Agreement between the parties relating to the purchase of product from Casablanca and supersedes all prior agreements between the parties relating to such subject matter. |
